This End-User License Agreement ("Terms of Service") is a legal agreement between you and Developing by Inspection LLC for QuadToneProfiler.

This EULA agreement governs your acquisition and use of our  QuadToneProfiler software ("Software") directly from Developing by Inspection LLC or indirectly through a Developing by Inspection LLC authorized reseller or distributor (a "Reseller").

Please read this EULA agreement carefully before completing the installation process and using the software. It provides a license to use the software and contains warranty information and liability disclaimers.

By clicking "accept" or installing and/or using the QuadToneProfiler software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this EULA agreement.

If you are entering into this EULA agreement on behalf of a Developing by Inspection, LLC or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software, and you must not accept this EULA agreement.

This EULA agreement shall apply only to the Software supplied by Developing by Inspection, LLC herewith regardless of whether other software is referred to or described herein. The terms also apply to any updates, supplements, Internet-based services, and support services for the Software.

License Grant

Developing by Inspection, LLC hereby grants you a personal, non-transferable, non-exclusive license to use the Software on your devices in accordance with the terms of this EULA agreement.

You are permitted to load the Software for up to two devices under your control. You are responsible for ensuring your device meets the minimum requirements of the Software.

You are not permitted to:

  • Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software nor permit the whole or any part of the Software to be combined with or become incorporated in any other software, nor decompile, disassemble or reverse engineer the Software or attempt to do any such things

  • Reproduce, copy, distribute, resell, or otherwise use the Software for any commercial profiling service

  • Allow any third party to use the Software on behalf of or for the benefit of any third party

  • Use the Software in any way which breaches any applicable local, national or international law

  • use the Software for any purpose that Richard Boutwell Photography considers is a breach of this EULA agreement

Intellectual Property and Ownership

Developing by Inspection, LLC shall at all times retain ownership of the Software as originally downloaded by you and all subsequent downloads of the Software by you. The Software (and the copyright, and other intellectual property rights of whatever nature in the Software, including any modifications made thereto) are and shall remain the property of Developing by Inspection LLC.

Developing by Inspection LLC reserves the right to grant licences to use the Software to third parties.

  Privacy

  • 1 Developing by Inspection LLC collects User information in an effort to improve User’s online experience, and to communicate with User about Richard Boutwell Photography’s products, services and promotions. Richard Boutwell Photography does not sell or rent User’s personal information to third parties. Richard Boutwell Photography does, however, share User’s information with third parties that provide services on Richard Boutwell Photography’s behalf or with whom Richard Boutwell Photography has partnered to offer a particular product or service.

  • 2 If Developing by Inspection LLC privacy policy changes, an updated version on the QuadToneProfiler support website. The policy revision date will be posted at the bottom of the page. User may exercise User’s choices about how Developing by Inspection LLC collects User information from time to time.

  • 3  Developing by Inspection, LLC may collect information User voluntarily submits , for example:

    (i) Identifying information such as User’s name and email address; (ii) Contact information such as User's name, mailing address and phone number; (iii) Queries for Technical Support; (iv) Browser information such as browser version, IP address, and the presence of various plug-ins and tools.

  • 4  Developing by Inspection, LLC collects information from User when User voluntarily submit that information to Developing by Inspection LLC, including, for example: registering on our websites, placing an order, subscribing to services, participating in one of our surveys, attending a seminar or workshop, or contacting Developing by Inspection, LLC for technical or customer support.

  • 5  Developing by Inspection, LLC employs third party vendors, service providers and suppliers to perform various functions on our behalf. Third-party services may include, but are not limited to: customer information management; processing credit card or check card payments analyzing data; developing, hosting and maintaining our websites and databases. Developing by Inspection, LLC does not authorize any of these service providers to make any other use of User’s information or to contact User outside the context of these services.

  • 6  Developing by Inspection, LLC utilizes security measures to protect the customer information it collects.

  • 7  Developing by Inspection, LLC site may contain links to other sites. Developing by Inspection, LLC does not control the privacy practices of those websites. Developing by Inspection, LLC shall not be responsible for the content and/or practices of any linked websites, and Developing by Inspection, LLC provides these links solely for the convenience and information.

  • 8 In the event of a security breach of Companies systems, Developing by Inspection, LLC agrees to notify users via their supplied email address as to the severity of the breach within 1 business day of the breach being identified.

Refund Policy

We offer a limited 5-day refund policy for mistaken purchases, subject to the following conditions:

  • Refund requests must be submitted within 5 days of purchase.

  • Refunds are only granted for mistaken purchases (e.g., accidental duplicate purchases or buying the wrong product).

  • Refunds will not be granted if the Software has been downloaded and used.

  • If a refund is granted, you must uninstall and delete all copies of the Software.

To request a refund, please contact support with your order details. Refunds are processed within 7–10 business days and will be credited back to your original payment method.

Termination

This EULA agreement is effective from the date you first use the Software and shall continue until terminated. You may terminate it at any time upon written notice to Developing by Inspection, LLC.

It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.

Governing Law

This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of The United States of America.
